Duluth Man Jailed on Rape Charge

The incident happened at a party in November, according to police.

A Duluth man has been jailed without bond and is facing a rape charge after an incident in November, according to police.

Slaidel Daniel Hernandez-Muniz of an Alpine Way address in Duluth was booked into the Gwinnett Detention Center on Dec. 4, according to jail records.

According to the Gwinnett Police report, the suspect had sex with the victim after she went to sleep on the floor at a residence where she and a friend had attended a party.

The victim had been drinking at the party, which was on Nov. 16, so the friend convince her to stay the night.

When the victim awoke, she said the suspect was on top of her. She told the suspect to stop, but it was not until the victim's friend overheard the victim's attempts to get the suspect off her that the women were able to leave the residence, police said.

The women contacted police about the incident after they had arrived back in Lilburn.

The victim said when she awoke at the party, that her pants were pulled down.

The friend said she also was sleeping in the room, when she heard her friend crying. The friend said she heard the victim say "stop." 

The friend said the suspect had a blanket over he and the victim.

Before leaving the residence, one of the women said she was able to take a picture of the suspect's driver's license.
